Contentious Property Lawyer


Virgin Media is currently searching for a Contentious Property Lawyer to sit within a new team within the Legal division. This is a brand new role that will provide direct support to our Wayleave Department who obtain and maintain rights of access over land prior to installation of our network.

The purpose of the role is to:
* Reduce the time taken to agree / implement wayleave documents through knowledge of legislation and ability to negotiate within legal parameters.
* Apply the new Electronic Communications Code powers including advising the business of the strengths or merits of a course of action; Empower wayleave officers to manage disputes with confidence and in a timely manner through accurate and consistent support.
* Reduce the volume of legal challenges on wayleave by working with legal / Claims to provide reference documents and training.
* Produce regular summary updates of claims progression in report format for key stakeholders including Head of Claims, Property Counsel and Wayleave.
In the role of Contentious Property Lawyer you would be responsible for a number of key activities including a few of the following:
* Produce high quality legal documentation including editing and negotiating specific wording, proof reading, technical drafting of contract clauses, with the ability to self-manage;
* To research and apply current legislation, specifically the Electronic Communications Code under Schedule 3A Communications Act 2003 to wayleave documents. To consider legislation and case law alongside guidance to properly advise and support our wayleave officers;
* To have a working knowledge of the old Electronic Communications code and to understand when this applies on aged agreements;
* Provide solutions to technical arguments where required;
* Support, train and develop members of the wider team to increase the skill set and knowledge.
As the right candidate for the role of Contentious Property Lawyer you will have some of the following:
* Solicitor or Chartered Legal Executive (private practice or in house)
* Comfortable with Communications Act 2003 and the Electronic Communications Code (examples will be required at interview)
* Knowledge of CPR in general and exposure to litigation (evidence of ability to litigate is beneficial as contentious experience will be required)
* Must have experience of managing a caseload of land disputes and an understanding of the Land Compensation Act is desirable.
